In their latest report, the New York State department of Motor Vehicles stated that 2009 saw a total of 314,974 accidents (only 256,953 reported to the authorities) and included a staggering 133,888 non-fatal personal injury accidents. Of these accidents, large truck accident cases accounted for 8% of the vehicles involved in accidents resulting in a minimum of one fatality; of the 4584 fatal accidents, a shocking 74% were combination trucks. However, trucks were only involved in 3% of crashes resulting in injury only, and 5% of crashes resulting in property damage only. Truck Accident Litigation Facts

According to www.roadsafeamerica.org, a website devoted to raising awareness of truck road safety, the fatal crash rate for accidents involving trucks is far greater than for any other road traffic accident.  Truck accident litigation then, is a significant part of all road accident legal affairs.  In the majority of truck accident lawsuits, the culpable party tends to be not the driver of the truck, but in fact the driver of the other vehicle involved.   In fact as truck accident claims stats will reflect, only 16% of truck accidents are actually the fault of the driver operating the truck, or heavy goods vehicle.

Truck Accident Claims

The highest amount of truck accident claims are seen in California, with 332 fatal truck accidents logged in 2003 alone.  Considering there are around 800 truck accidents a year, it’s no wonder that truck accident litigation is high in the ‘Orange State.’  From looking at the figures, in addition to California, one could sumise that truck accident lawsuits are more common in Florida, Georgia, Pennsylvania, and Texas.

Filing a Truck Accident Lawsuit

A truck accident lawsuit is usually filed against the following parties:

An Ohio truck driver involved in a truck crash that killed a New York woman on Dec. 12 pleaded guilty to manslaughter this week.

The accident occurred 20 miles east of Buffalo on the New York State Thruway. According to authorities, the trailer-truck driver was streaming pornography on his laptop prior to the crash and had also gotten little to no sleep the night before.

The woman was pulled over on the side of the highway because she had just hit a deer. While she was still in the car, the truck crashed into her, killing her instantly.

The 45-year-old trucker faces up to fifteen years in prison when he is sentenced in September.
