Do I Have to Talk to the Other Driver’s Insurance Company?

No, you are not obligated to discuss your accident with anyone outside of your own insurance company. In fact, it is recommended that you do not. After an accident, you will likely receive a phone call from the other driver’s insurance asking to speak to you and take a recorded statement. Since you have already reported the accident to your own insurance and likely given a recorded statement, there is no reason for you to give a second one.

Talking to the other driver’s insurance can actually hurt your case, because they may try to entrap you or confuse you into telling your story a different way. Instead of giving them information that they could later twist to use against you, it is better to not speak to the other party’s insurance at all.
