NYPD officer pleads guilty in fatal DUI accident

A former NYPD officer  pleaded guilty this Wednesday to charges of second degree manslaughter for driving while intoxicated and hitting and killing a woman in 2009.

He is expected to serve 90 days in jail, as opposed to the 7 years jail time he faced before.

The officer struck and killed a 32-year-old woman around 1 AM on Sept. 27, 2009, as she was leaving a wedding reception in the Mill Basin neighborhood. According to authorities, he was off-duty at the time of the accident.

Shortly after the accident, the officer refused to submit to a blood alcohol test. When a subpoena was obtained for the test several hours later, he tested clean. Given that he has now pleaded guilty to being intoxicated on the night in question, this brings the validity of the test into contention, and whether or not other officers helped him change the results.

His guilty plea on Wednesday, September 8, 2010, has been enough to satisfy the victim’s family. The woman’s father stated, “All I needed was for him to take responsibility, and he took responsibility.”

The officer will also be required to install an ignition lock on his car, complete an alcohol treatment program, and serve five years of probation. He has also resigned from the NYPD.

Apology from Cab Driver in Fatal Bus Shelter Crash

The taxi driver who crashed into a Bronx bus shelter last month, killing one man and injuring six others, has issued an apology.

According to officials with the New York State Federation of Taxi Drivers, Pedro Marte said he “wants the families to know that it wasn’t his fault. He did everything he could to avoid this terrible tragedy. But he totally lost control and it was out of his hands.”

A friend of Marte, Fernando Mateo, said the livery cab driver is torn up over the accident. Marte apparently swerved into the shelter because he was trying to avoid a minivan making an illegal U-turn on the street. The minivan was given a summons.

Bronx Comedian Robert Schimmel Dies After Car Accident

Legendary stand-up comedian and Bronx resident, Robert Schimmel died Saturday, a week after being injured in a car accident.

Howard Bragman, Schimmel’s representative, confirmed Saturday that the 60 year-old performer died Friday night at a hospital in Phoenix, Arizona. Police say the comedian was a passenger in a car driven by his 19 year-old daughter , Aliyah, when she swerved to avoid another car, causing the Schimmel vehicle to roll several times.

Schimmel’s 11 year-old son was also in the car but was treated and released from the hospital the same day. Bragman said 19 year-old Aliyah was listed in stable condition.

Schimmel was born in Bronx, New York in 1950.

Study of Pedestrian Accidents Debunks Common Assumptions

A new report released Monday by New York City’s transportation planners details where, when and why pedestrian accidents have most often occurred.

The New York City Transportation Department described the new study as the most ambitious of its kind. The report examined more than 7,000 crashes that occurred in New York City between 2002 and 2006, and only those resulting in serious injury to a pedestrian. The study undercuts some of the century-old assumptions about transportation in the Big Apple.

Taxis, and their stereotypically wild drivers, are not as menacing as many people believe. Cabs, buses, and trucks accounted for far fewer pedestrian accidents in Manhattan than did private automobiles. Jaywalkers were also involved in fewer collisions than their law abiding counterparts.

And in 80 percent of city accidents that resulted in serious injury or the death of a pedestrian, a male driver was behind the wheel.

5 Year-Old Injured in Bronx Hit-And-Run

A 5 year-old boy was injured Saturday night in a Bronx hit-and-run crash.

According to officials with the New York City Police Department, a dark colored sport utility vehicle struck 5 year-old Joshua Sanders and dragged him halfway down East 214th Street near Bronxwood Avenue Saturday. Police say Joshua was playing baseball with friend at a family cookout and ran into the street to retrieve a ball shortly after 6:30 p.m. when he was struck.

“The truck that hit him just kept driving,” said 35 year-old Horace Kelly. Witnesses say Joshua was dragged more than 50 feet before he was dislodged from the car. “He wasn’t breathing,” Kelly said. “He was just lying there.”

Police are still looking for the driver, who witnesses say stopped briefly before speeding away.

Woman Dies After Wilbur Cross Crash

A woman died following a Bronx car accident on the Wilbur Cross Parkway Wednesday.

According to officials with the New York State Police, 43 year-old Bronx-resident Jennifer Fasulo was pronounced dead at Yale-New Haven Hospital following a car crash on Route 15 early Wednesday. Police say the crash occurred shortly before 7:00 a.m. in the southbound lanes of the Wilbur Cross Parkway between exits 64 and 63.

Authorities say Fasulo somehow lost control of her vehicle, swerved and struck a tree. She had to be extricated from her car. Police continue to investigate the crash. Alcohol does not appear to be a factor.

Teen Bicyclist Struck By Unlicensed Driver

A 16 year-old bicyclist is in the hospital after he was hit by an unlicensed driver Monday.

According to officials with the New York City Police Department, the unidentified teen was struck Monday night as he rode down a hill on East 188th Street. Police say he made a hand signal while attempting to turn left on Webster Ave before the wreck.

The driver, a middle-aged woman who had two young children in the back seat of her Volkswagen Jetta, was traveling south on Webster Ave. when the crash occurred. Investigators believe she had a green light, according to police.

The force of the crash shattered the Jetta’s windshield and sent the victim’s bicycle flying through the air.

The woman remained at the scene following the crash. She was issued a summons for unlicensed operation of a motor vehicle.

Guilty Plea Expected in Fatal DUI Crash

A Bronx woman is expected to plead guilty to manslaughter on Tuesday in the death of an 11 year-old girl who was killed in a DUI crash on the Henry Hudson Parkway.

According to sources familiar with the case, Carmen Huertas is expected to receive a prison sentence when she pleads guilty to second-degree manslaughter. Prosecutors never offered Huertas a reduced sentence as part of the plea deal, second-degree manslaughter is the top charge she faced.

At an earlier court appearance, Justice Charles Solomon of State Supreme Court in Manhattan told the 32 year-old Huertas that if she pleaded guilty to the top count he would give her a sentence somewhere between the minimum – probation – and the maximum – 15 years in prison. Huertas’ attorney, Steven A. Rubin, said he could not comment on the plea deal, but his client is still coping with the tragedy. “Carmen still struggles with the aftermath of that tragic night, ” Rubin said. “She still morns the loss… and she morns the fact that she has not been able to see her own children regularly since she’s been incarcerated.”

Family of Bronx Car Accident Victim Plan to Sue

The family of a 76 year-old Philippine man who died in a Bronx car accident is planning to sue the two drivers involved in the crash.

According to the New York City Police Department accident report, the driver of a minivan made an illegal u-turn and collided with a taxi on the corner of Kingsbridge and University Avenue in the Bronx on August 10. That is when, police say, the cab driver struck Marcelino Adraneda and pinned him to a bus stop.

Adraneda was pronounced dead while en route to the hospital.

Several others were injured in the crash, including a woman whose legs were amputated. Two other people were in critical condition.

Ofelia Bernardo, Adraneda’s daughter, said she was upset with the emergency responders. “I was very angry. The police could not do anything. They were just there. The ambulance did not get there until 15 to 20 minutes after,” Bernardo said. “My father was bleeding profusely and we couldn’t do anything either. We couldn’t even push the cab off of him… We’re seeking justice. It’s unfair for my father who suffered so much. We lost our father because of two negligent drivers.”
